1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "Customer") and IBC Recycling Detroit ("we," "us," or "Company"), located at 35650 Stanley Dr, Sterling Heights, MI 48312. By accessing or using our website at ibcrecyclingdetroit.com ("Site") or engaging any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

2. Description of Services

IBC Recycling Detroit provides the following services related to Intermediate Bulk Containers (IBC totes, tanks, and related products):

• Buying and selling used, reconditioned, and reclaimed IBC totes
• IBC tote recycling and responsible disposal
• IBC tote cleaning and refurbishing
• Transportation and pickup/delivery of IBC containers
• Custom container solutions
• Sale of IBC accessories (valves, adapters, lids, etc.)

All services are subject to availability and may vary based on location, quantity, condition of containers, and other factors determined at our discretion.

3. Quotes and Pricing

All quotes provided through our Site, email, or other communication channels are estimates and are subject to the following conditions:

• Quotes are valid for 14 days from the date of issuance unless otherwise specified.
• Prices are subject to change based on market conditions, container availability, and condition upon inspection.
• Final pricing for buying or selling IBC totes may be adjusted after physical inspection of the containers.
• Transportation costs are determined by distance, quantity, and accessibility of the pickup/delivery location.
• All prices are quoted in U.S. Dollars (USD).

4. Buying IBC Totes from Us

When purchasing used or reconditioned IBC totes from IBC Recycling Detroit:

• All containers are sold "as-is" unless explicitly stated otherwise in writing.
• Product descriptions and grades (e.g., food grade, industrial grade) are provided to the best of our knowledge based on previous contents and condition.
• We make no warranty regarding the suitability of any container for your specific intended use. It is the buyer's responsibility to determine fitness for purpose.
• Payment is due upon or before delivery unless alternative terms have been arranged in writing.
• Minimum order quantities may apply for certain products.
• Bulk discounts may be available — contact us for volume pricing.

5. Selling IBC Totes to Us

When selling used IBC totes to IBC Recycling Detroit:

• You represent and warrant that you are the legal owner of the containers or are authorized to sell them.
• You must accurately disclose the previous contents of each container to the best of your knowledge.
• Containers that previously held hazardous, toxic, or regulated materials must be clearly identified and labeled.
• We reserve the right to inspect all containers before purchase and to decline any container at our discretion.
• Purchase prices may be adjusted if the condition or previous contents differ from what was represented.
• Payment for purchased containers will be issued within 7 business days of acceptance.

6. Recycling and Disposal

For recycling and disposal services:

• We accept IBC totes for recycling regardless of condition, subject to safety requirements.
• Containers must be properly emptied and, where applicable, rinsed prior to pickup.
• We do not accept containers containing or contaminated with radioactive, biological, or explosive materials.
• Recycling fees may apply depending on the condition and previous contents of the containers.
• We strive to recycle or repurpose all materials in an environmentally responsible manner in compliance with federal, state, and local regulations.

7. Transportation and Delivery

Regarding pickup and delivery services:

• Delivery and pickup dates are estimated and not guaranteed. We will make reasonable efforts to meet scheduled times.
• You are responsible for ensuring safe and accessible conditions at the pickup/delivery site.
• Risk of loss passes to the buyer upon delivery or upon the buyer's carrier taking possession of the goods.
• Any damage claims must be reported within 48 hours of delivery with supporting photographs.
• We are not responsible for delays caused by weather, traffic, road conditions, or other factors beyond our control.

8. Website Use

When using our Site, you agree to:

• Provide accurate and truthful information when submitting contact forms or quote requests.
• Not attempt to interfere with, disrupt, or compromise the security or functionality of the Site.
• Not use automated tools (bots, scrapers, etc.) to access or collect data from the Site without permission.
• Not use the Site for any unlawful purpose or in violation of these Terms.

9. Intellectual Property

All content on this Site — including text, graphics, logos, images, and software — is the property of IBC Recycling Detroit or its content suppliers and is protected by U.S. and international copyright laws. 10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• IBC Recycling Detroit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or services.
• Our total liability for any claim arising from a transaction shall not exceed the total amount paid by you for that specific transaction.
• We make no warranties, express or implied, regarding the merchantability or fitness for a particular purpose of any used or reconditioned IBC container.
• We are not liable for any loss, damage, or injury caused by the improper use, storage, or handling of IBC totes purchased from us.

11. Indemnification

You agree to indemnify, defend, and hold harmless IBC Recycling Detroit, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our Site or services, your violation of these Terms, or your misrepresentation of information provided to us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Macomb County, Michigan.
